1. Applying is voluntary
You choose to apply to A Foundery. Applying is free. Neither you nor A Foundery pays the other to apply, to review an application, or to communicate during the process.
2. No contract or obligation
Submitting an application does not create a job, a partnership, a contract, or any commitment on either side. A Foundery may accept, decline, pause, or remove any application at its own discretion, and is not obligated to explain a decision or to reply to every message.
3. Your uploads and your rights
Anything you upload must be your own work, or content you have the full right to share. Do not upload material owned by others, including copyrighted music, video, or other third-party content. By uploading, you grant A Foundery permission to store and review your submission only for the purpose of evaluating your application. You keep ownership of your own content.
4. No claims for time or content
You agree that you have no claim to payment or compensation from A Foundery for the time you spend applying, for our review of your materials, or for anything you choose to submit. Uploading content to A Foundery does not create any fee, invoice, license fee, or debt owed to you.
5. Communications
Messages you send through our application, portal, or email are received for the purpose of your application. We may not reply to every message. Sending a message does not create any obligation for A Foundery to pay you or to take any action.
6. Privacy
We use the information you provide only to run the application process and to contact you about it. We do not sell your information. You may ask us to remove your application by contacting us through your applicant portal. For full details, see our Privacy Policy.
7. Eligibility
You must be at least 18 years of age to submit an application. By submitting, you confirm that you meet this requirement.
8. Accuracy of information
You confirm that all information and materials you provide in your application are truthful, accurate, and not misleading. A Foundery reserves the right to reject or revoke any application found to contain false or materially misleading information.
9. No guarantee of selection
Submission of an application does not guarantee acceptance into any A Foundery program, cohort, or residency. Selection decisions are made at A Foundery's sole discretion.
10. Right to withdraw
You may withdraw your application at any time by contacting us through your applicant portal. Upon withdrawal, we will cease review of your application, though copies may be retained in our records for legal and administrative purposes.
11. Indemnification
By submitting, you agree to indemnify and hold harmless A Foundery, its affiliates, and its team members from any claims, damages, or expenses arising from your application materials, including but not limited to intellectual property disputes relating to content you uploaded.
12. Governing law
These terms are governed by the laws of the State of New Jersey, United States. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Middlesex County, New Jersey.
13. Changes to these terms
We may update these terms from time to time. The effective date shown above reflects the current version.
